Frequently Asked Questions
Answers regarding Indian debt laws, limitation periods, legal notices, and court procedures.
Under the Indian Limitation Act 1963, the limitation period for filing a commercial money recovery suit is generally 3 years from the date the cause of action arose (invoice due date or default date). However, any written acknowledgment of debt, confirmation of accounts, or part payment resets this 3-year clock under Section 18 and 19 of the Limitation Act.
Collection agencies have no judicial power and frequently resort to illegal harassment that triggers police FIRs or RBI penalties against creditors. Only licensed advocates can issue legally binding statutory notices, initiate Summary Suits (Order 37 CPC), petition NCLT under the Insolvency Code, file criminal complaints under Section 138 NI Act, and secure pre-judgment attachment of debtor bank accounts under Order 38 CPC.
Under Section 15-18 of the MSMED Act 2006, buyers must settle dues with registered MSMEs within 45 days. If they fail, the buyer is statutorily mandated to pay compound interest with monthly rests at 3 times the RBI bank rate. Filing before the MSEFC (Micro & Small Enterprises Facilitation Council) produces an enforceable arbitration award.
Yes. Under Section 138 of the Negotiable Instruments Act 1881, cheque bounce is a cognizable criminal offense punishable by up to 2 years imprisonment and twice the cheque amount as fine. We issue the mandatory statutory demand notice within 30 days of the bank return memo and file trial court proceedings with applications for 20% interim compensation under Section 143A.
Strictly yes. We follow the Reserve Bank of India (RBI) Fair Practices Code and legal advocate ethics. We do NOT engage in abusive calls, harassment, or unlawful physical intimidation. All communications are formally documented through legal notices, mediation protocols, and judicial filings.
We require copies of the Purchase Orders (PO), Invoices with GST details, E-Way bills, proof of delivery / lorry receipts (LR), ledger statements, and any communication (emails, WhatsApp, promissory notes, or dishonoured cheques). Our advocates examine these during your free claim audit.
