Under the Court Fees (Delhi Amendment) Act, court fees in Delhi are charged on an ad-valorem graduated slab. For suits between ₹5 Lakhs and ₹20 Lakhs, the court fee typically works out to 2.5% to 3.5%, with statutory fee caps in Delhi District Courts. Furthermore, under Section 35 of the CPC, successful plaintiffs are entitled to an award directing the judgment debtor to reimburse 100% of the court fees and legal costs.
Under Section 20 of the Code of Civil Procedure (CPC), jurisdiction is established where the defendant carries on business, resides, or where the cause of action wholly or partially arose (such as where the invoice was generated, goods were accepted, or payments were due). Delhi is split into 11 judicial districts across 7 court complexes: Tis Hazari, Patiala House, Rohini, Saket, Dwarka, Karkardooma, and Rouse Avenue.
In a regular civil suit, defendants can drag proceedings for years through repeated adjournments. In contrast, under Order 37 of the CPC, the debtor has no automatic right to defend. The debtor must enter an appearance within 10 days of receiving summons and satisfy the Delhi Commercial Court judge that they have a genuine triable defense. If they fail, an immediate money decree with interest is granted.

If they fail, a criminal complaint is filed before the Metropolitan Magistrate within 30 days.
